To the editor: AG Clark, Vermont lawyers ignoring the U.S. Constitution

This is a letter of response on the subject of Vermont Attorney General Clark and more than 300 Vermont lawyers who gathered in Burlington earlier this month to rally and protest against the Trump administration.

Why are  Clark and more than 300 Vermont lawyers blaming the Trump administration for the ongoing lawless choices and irresponsible spending of the majority of Vermont elected government officials?

For the past several years, a majority of Vermont elected officials have chosen to ignore the authority of U.S. federal laws and our U.S. and state constitutions as they have enacted Vermont laws and policies. Vermont’s ongoing over-spending problem and reliance on federal monies have also been ignored by the majority of Vermont elected officials.

Unlike previous U.S. presidential administrations, the Trump administration is now enforcing U.S. federal laws that have been unenforced for years. The enforcement actions of the Trump administration have exposed Vermont’s U.S. federal law violations. The corrections needed to Vermont’s ongoing violations have been communicated. The Trump administration has also communicated potential consequences if the circumstances necessitate them.

The Trump administration is also working to make some corrections to our U.S. government’s fraud, waste, abuse and over-spending problems; along with addressing our very large U.S. deficit of over $36 trillion. As a result, spending cuts of U.S. federal monies have been enacted reducing the amounts distributed to U.S. States including Vermont.

Many Vermonters have first-hand awareness of Vermont’s long-standing spending problem. A majority of Vermont elected officials refU.S.e to be economically responsible about Vermont state spending. As U.S. federal Spending cuts are enacted; there have been consequential effects to Vermont due to unrealistic state spending and reliance on U.S. federal monies.

It is tragic to hear there are so many Vermont Lawyers who agree with Vermont Attorney General Clark’s distorted view of the Trump administration’s enforcement of federal laws. As AG Clark and her Vermont Lawyer followers publicly rallied to protest, they showed their opposition to Vermont’s responsibility to adhere to our U.S. Constitution.

This action by a U.S. State Attorney General and more than 300 licensed lawyers defies logic, and common sense. Are law schools now omitting the teaching of our U.S. Constitution as the foundational law of our United States of America?

Or, are these so-called lawyers really activists pretending to be lawyers while seeking their own self-serving, lawless results? Ethical, honest and trustworthy lawyers will show respect and acknowledge the authority of our U.S. and state constitutions.

The Supremacy Clause (Article VI, Paragraph 2) is one of the most important provisions of the U.S. Constitution. It establishes that federal law is the supreme law of our country and, must be followed by state courts and  overnment officials. As each state joined the United States of America, they agreed to abide by the United States Constitution.

Below is a partial list of Vermont’s ongoing federal law violations:

  • Vermont’s ongoing actions as a known sanctuary state – violates U.S. immigration laws;
  • Vermont’s ongoing actions to harbor illegal aliens providing taxpayer resources of: housing, food, transportation, medical, legal, education, employment, driver licenses, etc. – violates U.S. immigration laws;
  • Vermont’s ongoing actions to allow illegal aliens to vote – violates both the U.S. and Vermont constitutions on the declared requirements of voters to be U.S. citizens;
  • Vermont’s ongoing actions to allow diversity, equity and inclusion policies throughout Vermont– violates U.S. civil rights law;
  • Vermont’s ongoing actions to allow gender dysphoric males to participate in female sports – violates U.S. civil rights law;
  • Vermont’s ongoing climate laws and actions to institute regulations over air quality and emissions – violates the U.S. EPA laws and jurisdiction;
  • Vermont’s ongoing laws and actions that allow racism – violates U.S. civil rights law.

Rather than advising and leading to make corrections to Vermont’s ongoing lawless actions, our elected Attorney General Clark, the highest Vermont elected law enforcement officer, has chosen to publicly display her radical ideology of lawlessness.

AG Clark chose to gather with more than 300 Vermont lawyers to publicly play the victim; to deflect, blame, and attempt to project Vermont’s existing legal and financial problems onto the Trump administration. Those who choose to think critically, and look deeper beyond the spin, gaslighting and lies, clearly see what is happening.

The majority of our Vermont elected officials including AG Clark are derelict and in violation of their oaths of office. They ALL committed and promised to: “Faithfully execute the duties of their position; to do equal right and justice to all persons according to the law; under the pains and penalties of perjury.”

Vermont elected officials didn’t expect to be held accountable by the U.S. federal government. Reality confirms that all choices and actions eventually have consequences. President Trump is not the “cause” of Vermont’s present financial and/or legal problems, but he is the exposer.

    The Trump administration’s go to strategy is to deflect, deny and project. In an only slightly more sophisticated way, Trump echoes the schoolyard retort “I know you are, what am I” to suggest others are actually doing what he does every day. Ms. Gassett’s letter to the editor reflects that strategy with absurd claims of law breaking by the very people working to counter the most lawless administration in history. While Trump ignores the Constitution, ignores the courts, cancels due process, encourages racism, sexism and transphobia, fosters poverty, and works to deny access to health care, courageous people like AG Clark, are fighting back on behalf of Vermonters.
